HIPAA Notice of Privacy Practices
**Effective Date: February 16, 2026** (Revised February 2026 to comply with federal regulations aligning HIPAA with 42 CFR Part 2 protections for substance use disorder records).
THIS NOTICE DESCRIBES HOW PSYCHOLOGICAL AND MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
I. Uses and Disclosures for Treatment, Payment, and Health Care Operations
We may use or disclose your protected health information (PHI), for treatment, payment, and health care operations purposes. To help clarify these terms, here are some definitions:
- “PHI” refers to information in your health record that could identify you
- “Treatment, Payment, and Health Care Operations”
- Treatment is when we provide, coordinate, or manage your health care and other services related to your health care. An example of treatment would be when we consult with another health care provider, such as your family physician or another psychologist.
- Payment is when we obtain reimbursement for your healthcare. Examples of payment are when we disclose your PHI to your health insurer to obtain reimbursement for your health care or to determine eligibility or coverage.
- Health Care Operations are activities that relate to the performance and operation of our practice. Examples of health care operations are quality assessment and improvement activities, business-related matters, such as audits and administrative services, and case management and care coordination.
- “Use” applies only to activities within our practice group, such as sharing, employing, applying, utilizing, examining, and analyzing information that identifies you.
- “Disclosure” applies to activities outside of our practice group such as releasing, transferring, or providing access to information about you to other parties.
II. Uses and Disclosures Requiring Authorization
We may use or disclose PHI for purposes other than described in this notice only with your written authorization. An “authorization” is written permission above and beyond the general consent that permits only specific disclosures. Specifically, we will not use or disclose your information for marketing communications or sell your information without obtaining your written authorization.
We will also need to obtain an authorization before releasing your psychotherapy notes. “Psychotherapy notes” are notes we have made about our conversation during a private, group, joint or family counseling session, which we have kept separate from the rest of your medical record. These notes are given a greater degree of protections than PHI.
You may revoke all such authorization (of PHI or psychotherapy notes) at any time, provided each revocation is in writing. You may not revoke an authorization to the extent that (1) we have relied on that authorization; or (2) if the authorization was obtained as a condition of obtaining insurance coverage, and the law provides the insurer the right to contest the claim under the policy.
Special Protections for Substance Use Disorder (SUD) Records Under 42 CFR Part 2
If your records include information related to substance use disorder diagnosis, treatment, or referral for treatment (protected under federal regulations at 42 CFR Part 2, or “Part 2”), these records receive additional privacy protections beyond standard HIPAA rules. Unlike other protected health information, we generally require your written consent to use or disclose these SUD records, even for treatment, payment, or health care operations (though a single consent may cover future uses for these purposes until revoked). You may revoke consent at any time in writing, except to the extent we have already acted in reliance on it.
SUD records, or testimony describing them, may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you unless authorized by your written consent or by a qualifying court order under Part 2 rules. Any recipient of these records must follow Part 2 restrictions and cannot redisclose them without your permission or as otherwise allowed by law. A general authorization for medical records is not sufficient to permit disclosure of Part 2-protected information.
We will handle SUD records only as permitted or required by Part 2 and applicable law. If you have questions about these protections or your rights related to SUD records, contact our office.
III. Opportunity to Object to Certain Uses or Disclosures
You have the right to tell us whether you want us to use or disclose your information for the following purposes:
- Share information with your family, close friends, or others involved in your care information that is directly relevant to that person’s involvement in your care or payment for care.
- Share information with your family, close friends, or others involved in your care as necessary to identify, locate, and notify family members, guardians, or others involved in your care about your location and general condition.
- In some cases, we may share limited information about you with a disaster relief agency in a disaster situation.
- If you are not present or unable to tell us your preference, we may go ahead and share your information if we believe it is in your best interest.
IV. Uses and Disclosures with Neither Consent nor Authorization
We may use or disclose PHI without your consent or authorization in the following circumstances:
- Child Abuse: If we have reasonable cause to believe that a child is dependent, neglected or abused, we must report this belief to the appropriate authorities, which may include the Cabinet for Health and Family Services (CHFS) or its designated representative; the commonwealth’s attorney; or local law enforcement agency or the Kentucky state police.
- “Dependent child” means any child, other than an abused or neglected child, who is under improper care, custody, control, or guardianship that is not due to an intentional act of the parent, guardian, or person exercising custodial control or supervision of the child.
- Adult or Domestic Abuse: If we have reasonable cause to believe that an adult has suffered abuse, neglect, or exploitation, we must report this belief to the Cabinet for Health and Family Services (CHFS).
- Health Oversight Activities: The Kentucky Board of Examiners of Psychology may subpoena records from us relevant to its disciplinary proceedings and investigations.
- Judicial and Administrative Proceedings: If you are involved in a court proceeding and a request is made for information about your diagnosis and treatment and records thereof, such as information is privileged under state law, we will not release information without the written authorization of you or your personal or legally- appointed representative, or a court order. The privilege does not apply when you are being evaluated for a third-party or where the evaluation is court-ordered. You will be informed in advance if this is the case.
- Serious Threat to Health or Safety: If you communicate to us an actual threat of physical violence against a clearly identified or reasonably identifiable victim or an actual threat of some specific violent act, we have a duty to notify the victim and law enforcement authorities.
- Workers’ Compensation: If you file a claim for workers’ compensation, you waive the psychotherapist-patient privilege and consent to disclosure of your health information reasonably related to your injury or disease to your employer, workers’ compensation insurer, special fund, uninsured employer fund or the administrative law judge.
- Law Enforcement Purposes: We may share your information with law enforcement consistent with applicable laws, such as if a crime is committed on our premises or against our staff, or if required in response to a valid court order.
- When permitted by law, we may also share information in certain situations as needed for purposes of public health and safety, for example, to prevent disease, assist with product recalls, or report adverse reactions to medications. When an individual dies, we can share health information with a medical examiner, coroner, or funeral director. We also can use or share your information for health research. We can share health information about you with organ procurement organizations. We may also share information for certain specialized government functions such as national security and presidential protective services.

- Right to Receive Confidential Communication by Alternative Means and at Alternative Locations – You have the right to request and receive confidential communication of PHI by alternative means and at alternative locations. - Right to Inspect and Copy – You have the right to inspect or obtain a copy (or both) of PHI in our mental health and billing records used to make decisions about you for as long as the PHI is maintained in the record. On your request, we will discuss with you the details of the request and denial process. Furthermore, there is a copying fee of $1.00 per page. Please make your request well in advance and allow 2 weeks to receive the copies.

If we deny your request, you have a right to file a statement that you disagree. On your request, we will discuss with you the details of the amendment process.
- Right to an Accounting – You generally have the right to receive an accounting of disclosures of PHI, except for information we used for treatment, payment, or health care operations purposes or that we shared with you or your family, or information that you gave us specific consent to release. On your request, we will discuss with you the details of the accounting process.
- Right to a Paper Copy – You have the right to obtain a paper copy of the notice from us upon request, even if you have agreed to receive the notice electronically.
